說明：
一、依本府人事處案陳銓敘部112年10月6日部法一字第11256217412號函辦理，並檢附原函影本1份。
二、111年6月22日修正公布之公務員服務法(以下簡稱服務法)第14條對於公務員投資限制規範，將原規定公務員僅得於一定持股比率範圍內，投資非屬其服務機關(構)監督之營利事業，修正為以公務員所任職務對營利事業具有直接監督或管理權限者為限。基於服務法第14條規範立法原意及為不過度限縮公務員投資行為，爰服務法第14條第4項就公務員所任職務對營利事業有直接監督或管理權限者之投資禁止規定，以其「所任本職職務」為限，尚不及於兼任職務(包含依法令規定由某機關（構）之特定職務人員兼任之當然兼職)。
三、又以公務員本不得利用其職務獲取不當投資利益，是無論於其本職或兼任職務，其他法規就公務員職權行使之衝突禁止及防止個人利益輸送等相關規定，仍應依各該規定辦理。
