說明：
一、 依教育部111年1月22日臺教人(三)字第1110008889A號函辦理。
二、 查性工法第2條規定：「（第1項）雇主與受僱者之約定優於本法者，從其約定。（第2項）本法於公務人員、教育人員及軍職人員，亦適用之。但第33條、第34條、第38條及第38條之1之規定，不在此限……。」據上，自111年1月18日起，現行相關教師法規如有與旨揭性工法及其施行細則修正條文及勞動部補充函釋規定等未盡相符者，於教師請假規則修正前，各學校得逕依性工法相關規定辦理，即教師如有陪伴其配偶妊娠產檢、分娩之事實及需求，得依性工法第15條之規定請陪產檢及陪產假7日，並得以時計；至教師之產前假日數，則仍依現行教師請假規則第3條第1項第4款所定之8日行之。
